Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Wizlix Technologies Private Limited ("Wizlix", "we", "us", "our"), which operates the Flozari product (the "Services"). They govern your access to and use of the Flozari website, application, APIs, and related services. By creating an account, signing in, or otherwise using the Services, you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Our Services

Wizlix provides Flozari, an Instagram and Facebook automation platform that helps creators and businesses build automated comment replies, DM workflows, lead capture flows, broadcast sequences, and related tooling. Features, pricing, and availability may evolve over time at our discretion.

3. Eligibility & Account

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
• You are responsible for the accuracy of your account information and for keeping your credentials and connected platform tokens secure.
• You are responsible for all activity that occurs under your account, including activity by team members you invite.
• Notify us immediately at support@flozari.com if you suspect unauthorized access.

4. Connected Platforms (Meta / Instagram / Facebook)

Flozari connects to third-party platforms such as Instagram and Facebook through their official APIs. Your use of those platforms remains governed by their own terms, including the Meta Platform Terms and applicable community guidelines. You agree not to use Flozari in a way that violates those terms. We may suspend automation if a connected platform requires it.

5. Acceptable Use

You agree not to use the Services to:

• Send spam, unsolicited bulk messages, harassment, or unlawful content.
• Impersonate any person or misrepresent your affiliation with any entity.
• Violate any law, regulation, or third-party right (including intellectual property and privacy rights).
• Reverse engineer, scrape, or attempt to bypass authentication or rate limits of the Services.
• Upload malicious code or interfere with the integrity, security, or performance of the Services.
• Resell, sublicense, or white-label the Services unless expressly permitted in writing.

We may suspend or terminate accounts that violate this section without notice.

6. User Content

You retain ownership of the messages, flows, media, and other content you submit to the Services ("User Content"). You grant Wizlix a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to operate and improve the Services. You represent that you have all rights necessary to grant this license and that your User Content does not violate these Terms or any applicable law.

7. Subscriptions, Billing & Refunds

• Paid plans are billed in advance on a recurring basis (monthly or annual) until cancelled.
• Fees are non-refundable except where required by law or expressly stated in our refund policy.
• You authorize us and our payment processors to charge your selected payment method for all applicable fees and taxes.
• We may change pricing for future billing cycles by giving you reasonable advance notice.
• You may cancel at any time from your account settings; cancellation stops the next renewal but does not refund the current period.

8. Free Trials & Promotions

Trials and promotional credits are offered at our discretion, are non-transferable, and may be modified or revoked if we detect abuse. Unless you cancel before the trial ends, your account will automatically convert to a paid subscription.

9. Termination & Suspension

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk to other users or to us, fail to pay fees when due, or if required by law or by a connected platform. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

10. Intellectual Property

The Services, including all software, designs, trademarks, and content (other than User Content), are owned by Wizlix or its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. No other rights are granted by implication.

11. Third-Party Services

The Services may interoperate with third-party platforms (e.g., Meta, Shopify, Kit, Mailchimp, Google). We are not responsible for the availability, accuracy, content, or practices of those services. Your use of third-party services is subject to their own terms.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Wizlix does not guarantee any specific outcome, deliverability, or compliance result on connected platforms.

13. Limitation of Liability

To the maximum extent permitted by law, Wizlix and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) USD 50.

14. Indemnification

You agree to defend, indemnify, and hold harmless Wizlix from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, or your breach of these Terms or applicable law.

15. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory consumer protections in your jurisdiction, you and Wizlix agree to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India for any dispute arising out of or relating to these Terms or the Services.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Services or by email. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
